Turkey convicted in ‘immunity' case

The European Court of Human Rights ruled yesterday that Turkey has violated Republican People's Party (CHP) Konya deputy Atilla Kart's right to a fair trial by reason of his parliamentary immunity. The case concerned Kart's complaint that he could not defend his name in criminal proceedings against him because, as a member of Parliament, he was subject to parliamentary immunity. He entered Parliament in November 2002 elections and was re-elected in July 2007 elections. Under Article 83 of the Constitution, no deputy suspected of having committed an offense before or after his election can be arrested, questioned, detained or prosecuted unless Parliament decides to lift his immunity.
